Finance a Hyundai through the dealer and the contract is serviced by Hyundai Motor Finance. Finance a Kia and it is Kia Finance America. Both are Hyundai Capital America doing business under each brand (its own FAQ says so), and their FAQ pages carry a word-for-word identical “Military Support” section (verified August 15, 2026). One SCRA desk, one email, one fax, one Atlanta mailing address, one three-business-day processing promise. The only line that differs is the phone number you call for information. Genesis Finance, the third brand, runs the same text with a third phone number.
Two things the pages do not do: print a rate, and mention the 2024 Justice Department settlement over repossessions. Both matter to how you file.

The cap, the forgiveness of interest above 6%, and the backdating to your orders date come from § 3937. If you paid a deposit or an installment before entering service, § 3952 bars repossession of the vehicle for a breach without a court order.
The 2024 consent order
On May 8, 2024 the United States filed a complaint against Hyundai Capital America in the Central District of California, alleging it repossessed 26 motor vehicles leased or owned by SCRA-protected servicemembers without first obtaining the required court orders. The court approved a consent order on November 26, 2024. It requires policies and procedures for motor vehicle repossessions that comply with the SCRA, SCRA compliance training for key employees, $10,000 plus any lost equity and credit repair for each affected servicemember, and a $74,941 civil penalty (DOJ case page, read August 15, 2026). Filing with Hyundai Capital America
File your SCRA request with Hyundai Motor Finance or Kia Finance America
- Confirm the contract predates your active-duty start date and note which brand holds it. Hyundai, Kia, and Genesis accounts go to the same desk but are addressed by brand.
- Write the request with your name and account number, and add the name, address, and phone number (with area code) of the person who will be driving or caring for the vehicle while you serve. The FAQ lists this as required; a request without it invites a follow-up.
- Attach a copy of your orders and, if you want the statute on the record, a § 3937 letter from the letter generator.
- Send it to SCRA@hcs.com, fax (888) 780-4423, or mail ATTN: SCRA Request, 4100 Wildwood Parkway, Atlanta, GA 30339, addressed to Hyundai Motor Finance, Kia Finance America, or Genesis Finance as the account requires.

Where Hyundai and Kia borrowers get tripped
The caretaker line is not optional. Hyundai Capital America asks who will be driving or caring for the vehicle during your service. That is an unusual line for an SCRA request, and leaving it out makes the request incomplete on the company’s own terms. Put a name, address, and phone number in the first message.
Same email, three brand names. SCRA@hcs.com receives Hyundai, Kia, and Genesis requests. State the brand and the account number in the subject line so it lands on the right account, and file once per account if you have more than one.
Nothing on the page says 6%. The FAQ points you to an outside overview for eligibility and never states a figure. That is a confirmed absence, not a lower or higher rate. Treat 6% as your floor and read the confirmation for the number actually applied.
The California deferral is a different law. The same Military Support section describes a payment deferral of up to 180 days for members of an Army Reserve component or the National Guard, under the heading California’s Military Reservists. It is a state benefit with its own 30-day review, filed by email with the subject line CA Active Duty. It does not reduce interest and it does not substitute for the federal cap.
Leased vehicles were in the 2024 case too. The complaint covered vehicles “leased or owned.” If you lease and receive PCS or deployment orders, termination is a separate right under § 3955 with a 30-day refund of advance amounts. Ask for it in writing.
Post-service contracts get neither cap. A Hyundai or Kia financed after your active-duty start is outside § 3937, and a purchase-money auto loan secured by the car is also excluded from the Military Lending Act’s 36% ceiling. What interest rate does Hyundai or Kia apply?

The statute sets the ceiling: 6% on any obligation you took on before active duty, with the excess forgiven and the credit backdated to your orders date. Ask for the applied rate in the confirmation.

Within 90 days of the start or end of an active-duty period, a member of an Army Reserve component or the National Guard called to active duty may request a payment deferral of up to 180 days, once every 365 days, by emailing SCRA@hcs.com with the subject line CA Active Duty; Hyundai says to allow up to 30 days for review. It applies to California accounts and does not replace the federal 6% cap.
