Nissan Motor Acceptance Company is the captive lender behind Nissan dealer financing and leasing, and INFINITI Financial Services runs on the same servicing operation. NMAC does something most captives do not: it names a dedicated desk, the Military Center of Excellence, and prints its phone, email, fax, and mailing address on a help-center article titled “SCRA Program Information” (last updated August 16, 2022, read August 15, 2026). The article also lists the benefits in plain terms, including the 6% rate and a waiver of certain fees.
The reason to read the whole page rather than just the phone number is the company’s history. NMAC settled with the Justice Department in 2019 for $3 million over repossessions and lease refunds, and both problems map onto rights you are about to exercise.

The 6% cap and its retroactive credit come from § 3937, which also defines fees as interest, so “certain fees” is NMAC’s phrasing for a duty the statute already imposes on any charge except bona fide insurance. Repossession without a court order is barred by § 3952 on any purchase or lease contract where you paid a deposit or installment before entering service. Lease termination is § 3955.
The 2019 settlement
The Justice Department filed a complaint and a settlement agreement on the same day, August 1, 2019, in United States v. Nissan Motor Acceptance Corp. (M.D. Tenn.). It alleged a pattern or practice of repossessing vehicles owned by 113 protected servicemembers without the required court orders, and a second pattern of failing to refund lease amounts paid in advance as capitalized cost reduction to servicemembers who terminated leases early after receiving qualifying orders. NMAC agreed to pay $2,937,971 in damages to servicemembers and a $62,029 civil penalty, $3 million in total, and to adopt new policies and training. - Confirm the retail contract or lease was signed before your active-duty start date, and pull the NMAC or IFS account number.
- Assemble what NMAC asks for: the servicemember’s name and date of birth, the account number, a copy of the active-duty orders, and proof of relationship if a spouse or dependent is filing.
- Send it to SCRA@nmac.com, fax (972) 607-7339, or mail NMAC, Attn: Military Center of Excellence, P.O. Box 660360, Dallas, Texas 75266-0360 (Infiniti contracts: same address, addressed to IFS). - Attach a § 3937 letter from the letter generator so the request names the statute and the type of relief you want (rate cap, fee waiver, lease termination, or all three).
- Expect a response within 3 business days. Confirm in writing that the 6% rate runs from the date of your orders, that the fee waiver is on the account, and that your payment dropped.

Where Nissan and Infiniti borrowers get tripped
“If applicable” means pre-service. NMAC’s rate line carries that qualifier because the cap only reaches contracts you signed before active duty. A Nissan financed after you shipped is outside § 3937, and a purchase-money auto loan is outside the Military Lending Act too (see MLA vs SCRA). Check the date on the retail installment contract, not the date you started paying attention.
The online form is a four-state door. NMAC’s Secure Contact Form for SCRA requests is currently limited to New York, California, Texas, and Florida. Everyone else uses email, fax, or mail. Email is the fastest paper trail; keep the sent copy.
Lease refunds are where the money hides. The 2019 case was not only about tow trucks. NMAC also failed to refund capitalized cost reduction, which is the down payment on a lease, when servicemembers terminated on orders. § 3955 requires advance amounts to be refunded within 30 days of the termination date. If you end a Nissan or Infiniti lease on PCS or deployment orders, ask for the refund calculation in writing.
A repossession needs a judge, not a notice. If you paid a deposit or an installment before entering service, NMAC cannot repossess for a breach without a court order. Does the cap apply to a Nissan lease?
