The Kentucky military car tax exemption
Kentucky charges motor vehicle property tax on a vehicle every year. If you are stationed here on orders and your home of record is another state, 50 U.S.C. § 4001 says that car is not Kentucky's to tax. Kentucky publishes no statewide form for the claim, which is where most people stall. Here is who actually grants it and what they want in hand.

The deadline
Keyed to the assessment date rather than a filing date: the LES you supply must cover January 1 of the tax year.
What Kentucky wants from you
- A copy of the servicemember’s LES covering January 1 of the tax year
- The LES must show a state other than Kentucky as the state of residence or taxable state
- For a spouse: both sides of a valid USID card showing the servicemember as sponsor, and/or a valid marriage certificate
How the Kentucky claim actually works
Kentucky assesses motor vehicles for property tax through the county Property Valuation Administrator, and the Department of Revenue states the rule simply: an active duty servicemember will not owe Kentucky property tax if they are in Kentucky on military orders and their LES does not indicate Kentucky as the state of residence or taxable state.
The date on the LES is the whole game in Kentucky, and it is a different rule from every other state in this cluster. Property tax here attaches to the January 1 assessment date, so the LES you submit must cover January 1 of the tax year. A current LES pulled in August does not answer the question Kentucky is asking, which is where you were domiciled on January 1.
Spouses are covered, and Kentucky is one of the few states in this cluster whose materials cite the Military Spouses Residency Relief Act at its live location, 50 U.S.C.A. § 4001, rather than the retired Title 50 Appendix. A non-Kentucky-resident spouse supplies both sides of a valid USID card showing the servicemember as the card sponsor, and/or a valid marriage certificate.
The claim is filed with the PVA in the county where the vehicle is registered, and payment itself runs through the County Clerk. Those are two different offices, which is a common source of a wasted trip.
What trips people up here
- The LES must cover January 1 of the tax year, not the date you file. This is the single most common Kentucky rejection.
- The PVA assesses and the County Clerk collects. Take the waiver paperwork to the PVA first.
- Kentucky cites the current 50 U.S.C. § 4001 rather than the superseded appendix, so quoting the old cite back at them adds nothing.
