- Year
- 2015
- Scale
- 2,413 servicemembers and co-borrowers
- Statute
- 50 U.S.C. § 3953
- Outcome
- By September 30, 2015, a total of 2,413 servicemembers and their co-borrowers were eligible for over $311 million. Under the NMS terms, identified servicemembers received $125,000 each, plus any lost equity in the property with interest.
What happened
The Justice Department announced that an additional 1,461 servicemembers and their co-borrowers were eligible for over $186 million for home foreclosures under settlements with five of the nation’s largest mortgage servicers. Combined with compensation announced earlier that February, the total reached 2,413 servicemembers and co-borrowers eligible for over $311 million.
The five servicers were JP Morgan Chase Bank N.A.; Wells Fargo Bank N.A. and Wells Fargo & Co.; Citi Residential Lending Inc., Citibank N.A. and CitiMortgage Inc.; GMAC Mortgage LLC, Ally Financial Inc. and Residential Capital LLC; and Bank of America N.A. with the Countrywide entities.
The compensation flows from the SCRA provisions of the National Mortgage Settlement rather than from a standalone SCRA lawsuit against each servicer.
The law behind this: 50 U.S.C. § 3953
Mortgages and trust deeds: sale, foreclosure, or seizure of property: read the statute.
Who was covered
Servicemembers and their co-borrowers foreclosed on by one of the five covered servicer groups within the settlement’s review period, without the court order Section 3953 requires.
What the settlement paid
- Over $311 million in total across the covered servicers, to 2,413 servicemembers and co-borrowers.
- Over $186 million of that was the later tranche covering an additional 1,461 people.
Why this case matters
The largest compensation total in SCRA history, and it reached co-borrowers as well as servicemembers, which most SCRA settlements do not.
If you think you were affected
Foreclosure compensation in these settlements is set per servicemember and runs to six figures, so it is worth establishing whether your dates fall inside a covered period.
This page is a record of a public enforcement action against JPMorgan Chase. It is not a claim form, and this site cannot tell you whether you are in the covered group. These are the routes that can.
- Read the Justice Department’s own record: DOJ press release (September 30, 2015) . Settlement administration and any claim process are run from there, never from here.
- Start with the § 3953 court-order requirement on a military mortgage , which is the protection this case was brought under.
- Contact your nearest Armed Forces Legal Assistance office. It is free for servicemembers and dependents, and it is the right first call on any SCRA question about your own accounts. Our guide to SCRA legal help explains the options.
- Confirm your covered dates before you argue about them. The Defense Manpower Data Center issues a free military status certificate; our walkthrough shows how to pull one.
