The 6% Interest Rate Cap
TD Auto Finance SCRA: 6% Cap, One Military Line, the Overseas Car Rule
Part of: The Complete Guide to the SCRA
What TD Auto Finance owes you
The cap is retroactive to your first day of active duty, and the excess interest is forgiven rather than deferred. Put your numbers in to see the size of your claim, then generate the letter that asks for it.
Simple-interest estimate on a fixed balance, capped at 6%: the 6% statutory ceiling (50 U.S.C. § 3937). TD Auto Finance publishes no lower rate, so 6% is your guaranteed floor. A revolving balance that moved over the period will differ. It sizes the claim; it is not an amortization schedule and not legal advice.
Write the letter to TD Auto Finance
Written notice is what starts the clock. Fill these in and the letter below is yours to copy, print, and send with a copy of your orders.
Where to send it: No online SCRA channel; the FAQ routes military benefit questions to the phone line and says documents cannot be sent to TD through its Secure Message Center
Nothing you type here leaves your browser. The letter is built on this device.
TD Auto Finance points military customers to the SCRA, but its own site says almost nothing about how the request works. Its customer FAQ, read October 10, 2026, has one military question, and the whole answer is that you “may be entitled to certain legal protections and debt relief” and should call 1-866-338-7968. There is no rate figure, no SCRA mailing address, and no processing time. The 6% cap does not depend on TD printing it. It is federal law, and it binds TD the same way it binds a lender with a full SCRA page.
TD Auto Finance is a division of TD Bank, N.A., and its FAQ calls it “an indirect lender”: you did not apply to TD directly, you financed through a dealer that works with it. Take a $24,000 TD contract at 11%, signed before your active-duty start date (an illustration; TD publishes no rates). The cap cuts 5 points, about $1,200 of interest a year if the balance held flat, or $100 a month, and the law forgives that money rather than deferring it. Put your own balance into the savings calculator.

Two rows change what you do. The thin SCRA answer means you build the paper trail yourself. And the overseas rule means a PCS to Germany, Japan, or Korea starts with a TD approval, not a shipping booking.
Turning one phone call into a protected request
Section 3937(b)(1) does not run on phone calls. You must give the creditor “written notice and a copy of” your orders, or another appropriate indicator of service such as a certified letter from your commanding officer, no later than 180 days after release from service. Once TD receives them, § 3937(b)(2) makes the cap effective as of the date you were called to service, so a request filed months into a deployment still reaches back.
TD publishes no SCRA address, so get one on the call. Phone 1-866-338-7968, ask where the SCRA team wants written notice and orders sent, and note the name, date, and answer. If you are told to mail it, the general correspondence address on TD’s contact page is PO Box 9223, Farmington Hills, MI 48333-9223; use Certified Mail with a return receipt. Do not plan on uploading orders through TD’s Secure Message Center: its FAQ says documents cannot be sent to TD that way. Draft the notice in the letter generator so it cites § 3937 and names the account.
Then check the result yourself. TD’s FAQ says the Details section of your online Account Summary shows your APR and the interest you have paid this year and last. After TD confirms the request, that APR should read 6% or less from your call-up date, and § 3937(a)(3) requires the monthly payment to drop by the forgiven interest. If you overpaid before filing, the refund guide covers the backdated credit.
Taking a TD-financed car overseas
This is the TD rule that matters most on a PCS. Its FAQ says approval to take a vehicle out of the country “can be granted for a short-term stay (with some exceptions) for select countries,” and that “if you are permanently relocating to a foreign country, you must pay off your vehicle before it is relocated.” It adds that accounts now or previously in bankruptcy may be ineligible. For military customers TD wants five things faxed to 1-888-548-3574:
- A current copy of your military orders, listing the base you are assigned to.
- Proof of active insurance on the vehicle in the destination country.
- Three references who can be used to contact you.
- The address the car ships from and the address it is going to.
- The duration of the stay.
Once approved, TD says a letter of permission comes by its Secure Message Center, fax, or mail within 48 to 72 hours. The FAQ does not say whether a three-year overseas tour counts as short-term, which is why the duration line matters. Call 1-800-556-8172 before you book shipping, and get the permission letter in hand first. The PCS money moves page covers the rest of the move.
Know what the SCRA does and does not do here. A loan is not a lease. Section 3955 lets you hand back a leased car on overseas orders, but nothing in the SCRA ends a purchase loan because you moved, and nothing in it overrides TD’s permission requirement. What carries over is the cap: a pre-service TD loan stays at 6% for your whole period of service, wherever the car is parked.
Late charges, extensions, and repossession
TD’s FAQ says late charges “vary by state” and sends you to your contract. On a capped loan they still count. Section 3937(d)(1) defines interest to include “service charges, renewal charges, fees, or any other charges (except bona fide insurance),” so a late fee that pushes your yearly cost above 6% has to come off. The late fees guide shows the math.
If a payment slips, TD’s FAQ points to Payment Assistance options in your Accounts Summary, including payment extensions. Before you sign one, ask in writing whether it changes your rate. And if you paid a deposit or any installment before entering service, § 3952 bars repossession for a breach “without a court order.” The repossession guide explains what a court can order. The site’s enforcement ledger shows no SCRA case against TD Auto Finance as of October 10, 2026.
Do not refinance a capped loan unless the new rate, after fees, beats 6%. TD offers no refinancing, and a new loan from another lender during service has no SCRA cap at all.

Frequently asked questions
Does TD Auto Finance offer SCRA benefits?
The SCRA binds TD like any other lender. TD Auto Finance's FAQ, read October 10, 2026, says a service member, spouse, or dependent "may be entitled to certain legal protections and debt relief" under the SCRA or state law and tells you to call 1-866-338-7968 to learn about eligibility. It states no rate. The rate is set by 50 U.S.C. § 3937: a loan signed before active duty cannot carry more than 6% during service, the interest above 6% is forgiven, and the cap runs from the date you were called to service.
What is the TD Auto Finance SCRA phone number?
TD Auto Finance's FAQ gives 1-866-338-7968 for questions about military benefits and SCRA eligibility (read October 10, 2026). Its general customer service line is 1-800-556-8172, Monday to Friday 8 a.m. to 10 p.m. ET and Saturday 8 a.m. to 7 p.m. ET. A call opens the conversation, but the statute asks for written notice and a copy of your orders, so ask the representative where TD wants the documents sent and write down the name, date, and answer.
Can I take my TD Auto Finance car overseas on PCS orders?
Only with TD's approval first. Its FAQ says approval to take a vehicle out of the country can be granted for a short-term stay, for select countries, once it has your documents. Military customers fax a current copy of orders listing the assigned base, proof of insurance in the destination country, three references, the from and to addresses, and the duration of stay to 1-888-548-3574. TD says a permission letter follows within 48 to 72 hours of approval. A permanent relocation abroad requires paying off the vehicle before it moves.
Can I refinance my TD Auto Finance loan while I am deployed?
Not with TD. Its FAQ says TD Auto Finance does not offer refinancing options at this time (read October 10, 2026). You could refinance with another lender, but a new loan signed during service is a debt incurred during service, which 50 U.S.C. § 3937 does not cap. If your pre-service TD loan is capped at 6%, refinancing throws that away unless the new rate, after fees, is below 6%.
Do late fees count toward the 6% cap on a TD Auto Finance loan?
Yes. Section 3937(d)(1) defines interest to include service charges, fees, and any other charges except bona fide insurance, so a late charge on a capped pre-service loan counts toward the 6% ceiling. TD's FAQ says late charges vary by state and points you to the contract you signed for the amount. Read that contract, add any late charges to the interest on your statement, and ask TD to credit anything that pushes the total above 6% a year.
How do I check that TD Auto Finance applied the 6% rate?
TD's FAQ says you can see your APR and your interest paid year to date, plus the prior year's interest, in the Details section of your online Account Summary, with a printable version under Documents. After TD confirms your SCRA request, check that the APR reads 6% or lower, that the change starts on the date you were called to service, and that the monthly payment dropped by the forgiven interest, as 50 U.S.C. § 3937(a)(3) requires.
