Part of: The Complete Guide to the SCRA

Your Kohl’s card is a Capital One card. Both versions, the Kohl’s Credit Card that works only at Kohl’s and the Kohl’s Rewards Visa that works anywhere, are issued by Capital One, N.A., according to the agreements Capital One filed with the CFPB for the second quarter of 2026. That matters because Capital One runs one of the better SCRA programs: its military page, read November 5, 2026, promises “no more than 4% interest” on eligible accounts it owns and services, two points under the 6% the SCRA requires, and “no fees assessed on accounts, except bona-fide insurance.”

People often guess the wrong bank. Many store cards are Synchrony cards (Amazon, Lowe’s, Sam’s Club), and some are Citi or TD cards (Macy’s, Target). A letter to the wrong bank does not count as notice to Capital One, and the clock keeps running.

What the cap is worth at 29.49%

Capital One’s pricing for both Kohl’s cards, offers as of June 30, 2026: a 29.49% purchase APR (prime plus 22.74%), no annual fee, and a late payment fee of up to $40. The Rewards Visa also charges 29.49% on balance transfers and cash advances, with a cash advance fee of $5 or 5%, whichever is greater.

Capital One program, 4%$60 (about $382 forgiven)

Your rate on the account you hold may differ from the new-account pricing above, so check your statement. The cap applies whatever the rate is.

Will the Kohl’s card get 4% or 6%?

Capital One’s 4% covers “eligible loans both owned and serviced by Capital One.” Its footnote sends two groups to the statutory 6%: loans owned and serviced by Fannie Mae, Freddie Mac or other private investors, and loans Capital One owns but a third party services. The footnote mainly matters for auto and home loans. The Kohl’s card is issued by Capital One and managed in the Capital One app, and Capital One’s form says it reviews “all of your Capital One and Discover accounts.”

What the page does not do is name partner cards. Nothing we read says a store card is excluded, and nothing says it is included. So put the Kohl’s account in your request by name, and read the decision letter for the rate. If it says 6%, you are still getting what the law guarantees. If it says anything above 6% on a pre-service balance, that is a violation, and the enforcement guide covers your next steps.

How to file with Capital One

Capital One’s Request SCRA Benefits page, read November 5, 2026, lists three routes: the online form, mail, or any Capital One or Discover branch, which forwards the request. Kohl’s stores are not on that list.

Cap your Kohl's card balance through Capital One

  1. Confirm the Kohl’s account was opened before your active-duty start date (for a Reserve or Guard member, before your “order to” date). The eligibility checker settles close calls.
  2. Update the mailing address on the account first. Capital One says a retroactive adjustment may arrive as a paper check sent to the address on file.
  3. File the online form at capitalone.com/military, or mail a signed request to Capital One, Attn: SCRA Request, P.O. Box 30285, Salt Lake City, UT 84130-0285. A spouse or dependent filing for you must use mail or a branch; the online form is for the servicemember.
  4. With a mailed request, include your orders or a commanding officer’s letter on official letterhead showing your name and Social Security number, active duty start date and branch. Capital One asks you not to send a military or government ID. The letter generator drafts the cover letter.
  5. Watch for the decision letter within two monthly billing cycles. Questions go to the 24/7 military line, 1-855-227-1645.
  6. On the next statement, confirm the lower rate and that no late fee posted. Keep paying on time: Capital One says it still reports payment history.

Capital One’s rules that beat the statute

A year to ask. The statute gives you 180 days after leaving service to send notice, under § 3937(b)(1). Capital One’s FAQ says it generally declines a request when “the active duty period ended more than one year before benefits were requested,” so a request made within a year of leaving is inside its policy. Send it within 180 days anyway, so you are covered by the law and not only by policy.

A year of relief after you leave. For a card, the statute’s cap ends when your service ends; only mortgages get the extra year. Capital One says its benefits “will remain on your account until one year after leaving or completing active duty,” and that it sends a letter at least 45 days before they end.

Retroactive to your start date. Capital One makes benefits retroactive to your active-duty start date, or your “order to” date for reservists, which matches § 3937(b)(2). The refund calculator checks the credit against what you paid.

The same FAQ lists the three usual reasons for a decline: the account was opened after your active-duty start date, your service ended more than a year before you asked, or the account was paid off or settled before your service began.

Opened the card while serving, or holding other cards

A Kohl’s account opened during active duty is not a pre-service debt, so the SCRA cap does not reach it; the Military Lending Act and its 36% Military APR limit apply instead. Neither Kohl’s agreement has a military section, and Capital One’s military page does not address the MLA. If you hold other Capital One or Discover cards, the same request covers them; the Capital One SCRA page covers the rest of the program, and the credit card guide walks through every other store card by issuer.

The law behind this: 50 U.S.C. § 3937

Who has been caught violating this protection

7 Department of Justice actions on interest rate cap in this site's ledger, newest first, each transcribed from the DOJ record.

  • Citibank, N.A. (Espin v. Citibank, private class action)(2023): On September 29, 2023, the court denied Citibank’s motion to compel arbitration, adopting the position the United States advocated. The underlying rate-cap claims continued in litigation; this record reflects the arbitration ruling only.
  • American Express National Bank (Padao v. American Express, private class action)(2023): No settlement stated in the DOJ record; the entry documents the United States backing servicemembers’ right to press SCRA rate-cap claims as a class.
  • BayPort Credit Union(2022): Consent order (entered March 18, 2022, four-year term): $69,443.10 deposited in escrow to compensate 21 servicemembers whose 6% rate requests were denied or misapplied and three servicemembers whose vehicles were repossessed without court orders, with BayPort to add funds if the payments came to more (DOJ’s case page says $69,443.10 to 24 servicemembers; the complaint places one soldier in both groups), a $40,000 civil penalty, and changes to BayPort’s SCRA rate-benefit and repossession policies plus employee training.
  • Westlake Services, LLC and Wilshire Commercial Capital(2022): Settlement addendum (September 27, 2022): $185,460 to 250 servicemembers who were not backdated or who waited more than 60 days, an additional $40,000 civil penalty, and revised SCRA policies, procedures, and training.
  • Conn Credit I, LP, Conn Appliances, Inc., and Conn’s, Inc. (Conn’s HomePlus)(2020 to 2021): Consent order (entered January 29, 2021): refund all overcharged interest plus an additional $500 to each servicemember, a $50,000 civil penalty, and an independent consultant hired to identify every affected servicemember, over a three-year term.
  • Sallie Mae (Navient Solutions, Navient DE Corporation, Sallie Mae Bank)(2014): $60 million in compensation, with about 60,000 servicemembers estimated to receive payments, plus a $55,000 civil penalty. Sallie Mae also had to ask all three credit bureaus to delete negative entries caused by the overcharges and improper judgments, and to stand up a streamlined SCRA intake process.

Frequently asked questions

Who issues the Kohl's credit card?

Capital One, N.A. The Kohl's Credit Card and Kohl's Rewards Visa agreements filed with the CFPB for the second quarter of 2026 are both titled "in Capital One, N.A.," and Capital One's Kohl's card page says the card and its services are offered by Capital One, N.A. It is not a Synchrony or Comenity card, so an SCRA request sent to either of those banks will not reach your Kohl's account.

Does the Kohl's card get Capital One's 4% SCRA rate?

It should, but confirm it. Capital One's military page, read November 5, 2026, promises no more than 4% on "eligible loans both owned and serviced by Capital One," and its request form says it reviews "all of your Capital One and Discover accounts." The Kohl's card is a Capital One card that you manage in the Capital One app. The page does not list partner cards by name, though, and its footnote gives only 6% to accounts a third party services. Ask Capital One to state the applied rate in its decision letter.

How do I request SCRA benefits on my Kohl's card?

Through Capital One, three ways, per its Request SCRA Benefits page read November 5, 2026: the online form on capitalone.com/military, mail to Capital One, Attn: SCRA Request, P.O. Box 30285, Salt Lake City, UT 84130-0285, or in person at any Capital One or Discover branch. A mailed request needs your active duty orders or a commanding officer's letter on letterhead showing your name and Social Security number, active duty start date and branch. Capital One's 24/7 military line is 1-855-227-1645.

How long does Capital One take, and how is the refund paid?

Capital One says to look for a decision letter within two monthly billing cycles, and that different account types can update at different times, so you may get more than one letter. Retroactive adjustments may be paid as a paper check mailed to the address on the account. Update that address before you deploy or PCS, or the check goes to a house you have left.

Will my Kohl's Cash expire while I am deployed?

It can. Capital One's Kohl's card page says rewards convert to Kohl's Cash in $5 increments on the first day of the following month, and that you have 30 days to spend it. Kohl's Cash issued while you are deployed will lapse unless someone uses it for you. The SCRA does not extend it. Spend what you have before you leave.
